Welcome to our website. Please read these terms and conditions carefully before using this site. Your use of this site and the taking up of any of our Services constitutes that you are agreeing to comply with and are therefore bound by the following terms and conditions.
If you object to anything in these Terms and conditions of service, or do not agree to them, then you must not tick the agreement of terms and conditions box located on the ‘book now’ page or on the agreement form that you must sign to gain use of our services; as by ticking the aforementioned box, you are agreeing to the following Terms of Service as well as to all following conditions.
In these Terms of Business the following definitions apply:
“The Company”, “We”, “Us” – means Mop Angels.
“Housekeeper/ Cleaner/Home Help (PA)/ Handyman/ Garden Maintenance/ Pet Service” – means the person or firm carrying out services on behalf of the Company.
“Client” – means the person, firm to whom the Housekeeper/ Cleaner/ Home Help (PA) / Handyman/ Garden Maintenance/ Pet services are supplied by the Company.
“Service” – means the work the Housekeeper/ Cleaner/ Home Help (PA) / Handyman/ Garden Maintenance/ Pet services carried out and completed by independent contractors, on behalf of the Company.
“Worker” – refers to the Housekeeper/ Cleaner/ Home Help (PA)/ Handyman/ Garden Maintenance/ Pet Service operative introduced to the Client by the Company.
“Visit” – means the visit to the Client’s address by the worker in order to carry out the Service.
Unless the context requires otherwise, reference to the singular include the plural and references to the masculine include the feminine and vice versa.
The Headings contained in these Terms are for convenience only and do not affect their interpretation.
These Terms and Conditions represent a contract between Mop Angels and the Client.
All workers introduced to the Client by The Company are introduced and acknowledged by the Client as being self-employed and are retained by the Client as such.
The Client agrees to provide a task/errand priority list for their worker – when necessary, noting what work is prioritised within the booking time available. These priorities must be realistic, given the length of booking and may not be completed if time does not allow. Workers will ultimately try their best to complete all prioritised tasks or errands, in the given time.
The Client agrees that any use of the Company’s services, including placing a booking request for services by telephone, email or by use of our website forms shall constitute the Client’s acceptance of these Terms and Conditions.
Unless otherwise agreed in writing by the owner(s) of Mop Angels, these Terms and Conditions shall prevail over any other terms of business or purchase conditions put forward by the Client.
No variation or alteration of these Terms and Conditions shall be valid unless approved in writing by the owner(s) of Mop Angels.
The Client shall provide a safe working environment for their Angel at all times.
- The Company Connects Workers with Clients
Clients are individuals/ family units seeking to obtain housekeeping/ domestic cleaning/home help/deep clean/pet/handyman/basic maintenance/ pet services from self-employed workers willing to complete the requested service and are therefore clients of these workers, and workers are individuals seeking to perform work for Clients. Clients and workers together are hereinafter referred to as “Service Users.” Mop Angels are hereinafter referred to as “The Company”.
- Worker Classification
Each Service user (client) assumes all liability for the proper classification of such workers (Angels) as independent contractors or employees based on applicable legal guidelines.
Service Users do not have authority to enter into written or oral (whether implied or expressed) contracts on behalf of the Company. Each Service User acknowledges that the Company does not, in any way, supervise, direct, or control an Angel’s work in any manner. The Company does not set an Angel’s work hours or location of work. The Company will not provide any equipment, labour or materials needed for a particular task.
The Service is not an employment service and the Company does not serve as an employer of any Service User. As such, the Company will not be liable for any tax or withholding, including but not limited to PAYE, National Insurance contributions, employer’s liability, social security or any other employer tax or contribution in connection with your use of Users’ services.
You agree to indemnify, hold harmless and defend the Company from any and all claims that an Angel was miss-classified as an employee of The Company, any liabilities arising from a determination by a court, arbitrator, government agency or other body that an Angel was miss classified as an employee (including, but not limited to, taxes, penalties, interest and Solicitors fees), any claim that the Company was an employer or joint employer of an Angel, as well as claims under any employment-related laws, such as those relating to employment termination, employment discrimination, harassment or retaliation, as well as any claims for overtime pay, sick leave, holiday or vacation pay, retirement benefits, worker’s compensation benefits, unemployment benefits, or any other employee benefits.
- Workers (Angels) who register their interest in working with The Company and who are subsequently offered work as an independent contractor with The Company must adhere to these terms and conditions, where they are relevant to them. An example would be section 18.i. By registering with The Company, you are agreeing that whilst you are registered with The Company – and for a calendar year after you de-register; that you will not work with a client of Mop Angels who is either an existing client, or a client who has ceased using the services of The Company – where the time elapsed has been less than a calendar year.
- Company Definition
The Service is a platform for enabling connections between Service Users for the fulfillment of housekeeping/cleaning/home help/deep clean/pet/handyman/garden maintenance services. The Company is not responsible for the performance of Users, nor does it have control over the quality, timing, legality, failure to provide, or any other aspect whatsoever of services, clients, nor of the integrity, responsibility or any of the actions or omissions whatsoever of any Users. The Company does not have control over the quality, timing or legality of services delivered by the Angels. The Company makes no representations about the suitability, reliability, timeliness, or accuracy of the services requested and provided by Users identified through the Service whether in public, private, or off-line interactions. The Company is not to be held legally responsible for any dispute between Service Users and by signing to these terms and conditions; you indemnify The Company against any possible legal action.
- User Vetting
Workers (Angels) may be subject to a vigorous vetting process, including but not limited to verification of identity and the possibility of a comprehensive criminal background check (DBS) using third party services as appropriate. Service Users hereby give consent to the Company to conduct background checks as often as required in compliance with UK law.
Although the Company may perform background checks of Service Users, as outlined above, the Company cannot confirm that each Service User is who they claim to be and therefore, the Company cannot and does not assume any responsibility for the accuracy or reliability of identity or background check information or any information provided through the Service.
When interacting with other Users, you should exercise caution and common sense to protect your personal safety and property, just as you would when interacting with other persons whom you don’t know.
- Access to Property
Your Angel will require access to your property to complete their agreed service with you. Arrangement between yourself and your Angel must be made to allow for this. The Company provides a Key Security Form for both the Angel and the Client to fill in and sign (if required).
The Angel is not responsible for any installed alarms triggered during a service visit. The Client must provide both the Angel and The Company with full instructions for disabling and/or re-setting the alarm system within the property
- Equipment and Materials
Housekeeping/ domestic cleaning. All general Cleaning materials such as eco – products, solutions, cloths, sponges, gloves etc. and equipment such as a vacuum cleaner, iron, ironing board, mop and bucket, broom etc. are provided by your Housekeeper or Cleaner.
Home help (PA). All general Cleaning materials such as eco – products, solutions, cloths, sponges, gloves etc. and equipment such as a vacuum cleaner, iron, ironing board, mop and bucket, broom etc. are provided by your Housekeeper.
The Company hold Public Liability, Personal Injury and Accidental Damage insurance.
The limit of the cover of Public Liability insurance is no less than a minimum of £1,000,000.
The householder (client) agrees to hold adequate, up to date insurance cover in place against liabilities to the worker (Angel) in their employ and shall produce to the Company a copy of the appropriate insurance policy and certificate if so requested (This may be in form of general household insurance policy).
There is a £250 excess on any claim accepted by The Company, of which £100 are paid by the Client and £150 by the Company.
Neither Mop Angels nor its insurers shall be liable for the first £100 of any claim or for any claim of £100 or less in value.
The Company reserves any right to refuse to disclose any confidential company documents.
The Company does not carry specialist pet cover insurance or licenses. In taking up this service, you are releasing Mop Angels and anyone connected with it from any claim related to you and your pets use of the service and agree that take up is at the owners own risk.
Handy man and garden maintenance contractors carry their own insurance and it is the responsibility of clients to ensure that all contractors referred by The Company, have valid insurance. In taking up this service, you are releasing Mop Angels and anyone connected with it from any claim related to your use of the service and agrees that take up is at your own risk.
The Company shall issue a full refund to a Client if their introduced housekeeper/ domestic cleaner or home helper fail to turn up for agreed work which has been pre-paid by the Client.
The Company is not liable for:
Completing jobs listed on the customer’s task list.
Completing jobs where sufficient cleaning products/equipment was not supplied to allow for completion of the job.
Any third parties or their actions that enter or are present at the client’s premises during the service visit.
TV, Laptop and PC screens and Keyboards will not be cleaned by your Angel and the Company is not liable for any damage to such items.
One of a kind items or any item of high value, is not covered by The Company insurance and by placing a booking request for services by telephone, email or be use of our on-line booking system shall constitute the Client’s acceptance of such. It is the client’s responsibility to either remove such items or to ensure that they inform workers to stay away from these items.
Any wear and discolouration of fabric that becomes more notable once dirt is removed, or the removal of old/permanent stains that are not affected by standard cleaning methods on fabrics and carpets.
The removal of any stains, spillage or damage that cannot be completely removed by the cleaning products/equipment provided by the customer or standard carpet cleaning measures.
Any damages caused by faulty products/equipment provided by the customer.
The failure of any Angel to return keys and any loss that may arise as a result, including: collusion or theft of property or possessions by an Angel.
The customer agrees to secure or remove any fragile, breakable or highly valuable items and also to inform the Angel to avoid them.
Items excluded from the Company’s liability include: cash, jewellery, art, antiques and items of sentimental value.
If transport is required (other than the workers own), then it is your (the client) responsibility to provide it and if necessary, the correct insurance to enable your worker (Angel) to legally use that transport. If an agreement is reached with your Angel to use their own transport, then you agree to reimburse your Angel any extra costs including fuel and parking. You also agree that your use of their transport (as a passenger) is at your own risk and any claim relating to use of their transport is null and void.
Client’s must accept and understand that on occasion Angels may need to use public transport and any delays or strikes may affect their Angels punctuality.
Users of the Service may be required to provide their bank account details to the Company for processing and payment.
Payment is required in full, to The Company, by one of the following methods: Cash payment for the pet and heavy lifting service and online via our website using the PayPal payment facility for all other in house services.
The Client authorises the Company to provide their (the client) payment details to the bank (if required) for processing of their workers (Angels) payment, any out of pocket expenses owed to their worker (if not already paid),any tip or gratuity, if applicable, and the service fees and trust and safety fees owed to the Company for the use of the Service.
Clients will be responsible for paying the whole sum for any work provided by or on behalf of The Company, which will include (i) the pricing terms of the work agreed with and provided by an Angel (“Service Payment”), (ii) any out of pocket expenses agreed with and submitted by an Angel in connection with the service provided and not paid directly to the Angel, when agreed, (iii) any tip or gratuity, if applicable.
For your convenience, all Angels and other contractors supplied by The Company are paid directly by us (not the client), following collection and processing of your payment and the agreed work being done.
Clients agree to authorise the Company to charge their bank account (if required) with any outstanding balances due.
The Company reserves the right to charge interest on invoiced amounts which remain unpaid after 30 days from the invoice generation, at a rate of 2% above the Bank of England base rate, from that date until full outstanding payment is paid.
Any bank charges incurred due to a client’s payment being rejected will be passed on to the client at a flat rate of £35 plus the outstanding balance.
Users of the Service will be liable for any taxes (including VAT, if applicable) required to be paid on the Services provided under the Agreement (other than taxes on the Company’s income).
- Cancellation or re-scheduling
If a Client needs to change a service day or time, the Company will do its best to accommodate that request.
Important A minimum 48 hour notice is required when amending or canceling an agreed service, otherwise the client must pay the full service amount owed within 3 working days past the pre-booked service date. Please note that if amending a booking, the Company cannot guarantee that the same operative will be available on the new day and time the client requires. Any changes in the service schedule are subject to availability.
No refund claims will be entertained once the Housekeeper/ Cleaner/ Home Help (PA)/ Handyman/ Garden Maintenance service has been carried out.
A refund will be issued only if the Client has canceled a scheduled visit within the allowed time (48 hours) prior to the start of the Housekeeper/ Cleaner/ Home Help (PA)/ Handyman/ Garden Maintenance session and a payment has been already taken by the Company.
A refund will be issued if a worker does not attend a scheduled visit, where payment has been collected by the Company.
Reports of poor service, breakages or damage MUST be reported by the customer to the Company with 24 hours of the service visit.
Reports received after this time frame will not entitle the customer to any refund or replacement service.
The Company will respond to any complaint reports within 5 working days after receipt of report.
Complaints must be made in writing via email and must be received by the Company within 24 hours of the service visit.
- Special Offers, Gift Cards or Vouchers
Company gift cards (“Gift Cards”) and vouchers or promotional codes (“Vouchers”) may be available and can be used to pay for service bookings in part or in full, but may not be used to pay for reimbursement of out of pocket expenses and Company fees associated with a service. Vouchers are an offer (subject to the terms and conditions of the voucher) by the Company to reduce the amount a client has to pay in relation to a service payment and/ or our fee. Vouchers will not affect the amount of the service payment an Angel receives. You agree that you will only use one voucher per person, and will comply with Voucher terms, including but not limiting voucher use to first-time users (which means that you will not use such a voucher with a new account you create if you already have an account on the Service).
Gift Cards are not redeemable for a cash equivalent.
A Gift Card cannot be used as a credit or debit card. Company reserves the right to limit quantities of Gift Cards purchased by any person or entity and to cancel a Gift Card if it believes that the Gift Card was obtained through fraudulent or unauthorized means.
You may terminate this Agreement (giving 48 hours prior notice) by ceasing all use of the Service. All sections which by their nature should survive the expiration or termination of this agreement shall continue in full force and effect subsequent to and notwithstanding the expiration or termination of this agreement.
The Company may terminate or suspend your right to use the Service at any time for any or no reason by providing you with written or email notice of such termination, and termination will be effective immediately upon delivery of such notice.
- 1. The Client agrees that they will not approach or engage directly their Housekeeper/ cleaner or Home Help (PA), Handy man, Garden maintenance or Pet service workers (or any other worker), who has been introduced to the client by our Company, for the duration of the worker remaining on our register and for a 6 month period following the workers’ decision to terminate their inclusion on our register. The client also agrees, to not directly introduce their Housekeeper/ Cleaner or Home Help (PA), Handy man, Garden maintenance or Pet service workers (or any other worker), to a third party for the purpose of engaging them to work independently of The Company (Mop Angels). In the case that this agreement is breached; the client agrees to pay a recruitment fee of £500 to The Company (Mop Angels). Otherwise we (The Company) will take the client to the small claims court for the aforementioned compensation. The client further agrees to pay all costs incurred by The Company (Mop Angels), in relation to this action.
By providing your home or/and mobile phone number and using the service, you hereby affirmatively consent to our use of your mobile phone number for calls and texts in order to perform and improve upon the Service.
The Company acknowledges how important privacy is to you and is therefore committed to honouring that privacy. All personal (excluding address information which is needed by your Angel) and banking information obtained is gathered for the purpose of billing the client for services rendered by your Angel. The Company will not disclose any personal information to a third party, except for the purpose of completing your financial obligation to The Company.
21. Pet sitting service
By booking our pet sitting service the client is agreeing to ALL the terms and conditions set out in this website; including:
- The client will be asked to complete relevant form(s) about their pet and sign to confirm it is correct.
- The client’s emergency contact can make decisions regarding the client’s dogs health should the need arise.
- Once arranged every booking will be undertaken by the pet carer unless in exceptional circumstances.
- The Client is responsible for ensuring that their dog has a suitable lead and collar, that the dog cannot remove, for dog walks. They should also ensure that the collar contains a dog tag with their up to date contact details on.
- The Client confirms that by using this service, their pet(s) have up to date inoculations and any necessary flea treatments.
- If Friends for Pets cannot make contact with the client or emergency contact and If the client’s pet is ill whilst in the care of Friends for Pets and veterinary treatment is required, then Friends for Pets shall act on the advice of a Veterinary Surgeon. The client agrees to pay any Vet bills on their return.
- The company cannot accept any liability for the loss or injury to any pet. The Client is responsible for ALL damages caused by their pet, including injury to another person or animal.
